OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.
1. PROMOTION DATES
1. PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES AND DECISIONS, CONSENT TO USE AND RELEASE OF CLAIMS. By entering this promotion, each participant warrants that he or she has read and agrees to abide by these rules ("Official Rules") and that he or she is not prohibited from participating in the Diamond Drop Contest (the "Promotion"). Participation in this promotion constitutes participant's full and unconditional acceptance of these Official Rules and the decisions of Community Newspaper Holdings, Inc. ("CNHI"), SEI Media Group (which is comprised of The Greensburg Daily News, The Rushville Republican, and The Batesville Herald-Tribune – collectively the "Group") and Huntington Jewelry (CNHI, the Group and Huntington Jewelry individually and collectively referred to herein as "Sponsor"), and their respective subsidiaries, affiliates, employees and agents, which are final, binding and non-negotiable in all respects. Each participant agrees to release, discharge, indemnify and hold harmless each Sponsor and their respective subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the promotion and/or the receipt or use of the prize awarded in connection with the promotion, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Further, participant fully and unconditionally releases all claims for consideration, copyright infringement and all other claims of any nature relating to the use of participant's entry, name or likeness.
2. PROMOTION DATES. The Promotion will begin at 12:00:00 PM ET on Monday, February 8th, 2016 and will end on the date and time on which the marble drops from the ice sculpture, or Monday6:00 pm ET on Friday, February 15th12, 2016, (whichever occurs first).) ("Promotion Period"). Entries will be accepted until 5:00:00 PM ET on Tuesday, February 9th, 2016 for online entries, or until closing time (approx. 5:00pm ET) on February 9th, 2016 for in person entries.
2.3. ELIGIBILITY RESTRICTIONS
a.. The Promotion is open to all legal residents of the United States and the District of Columbia (except NY, RI and FL) who are 18 years of age or older at the time of entry and who live in one of the following counties in Indiana: Decatur, Rush, Franklin and Ripley (collectively, the "Eligible Counties"). Employees of SEI Media Group (which includes The Greensburg Daily News, The Rushville Republican, The Batesville Herald-Tribune) (collectively, the "Group"), its parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other newspapers in the Eligible Counties, and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, in NY and FL, as applicable, and where prohibited. Employees, agents, independent contractors and affiliates of a Sponsor and immediate family members of all such persons, are not eligible to participate in the Promotion. Proof of age and identity must be furnished upon request. Sponsors reserve the right in their sole discretion to cancel, terminate, suspend or amend the Promotion at any time for any reason without prior notice. Sponsors further reserve the right to amend these Official Rules at any time without prior notice, in their sole discretion. Sponsors reserve the right to disqualify any participant for any reason, including, but not limited to, violation of these Official Rules or infringement of the rights of a third-party. A Sponsor is not responsible for any printing or typographical errors in any material associated with the sweepstakes.
b. Only one winner per household is permitted in any Group-conducted contest/sweepstakes.
c. Winner must sign a participant release and hold a valid driver's license.
d. Entrants are required to provide truthful information and the Group will reject and delete any entry that it discovers to be false or fraudulent. The Group will disqualify any entry from individuals who do not meet the eligibility requirements, and will also delete any entry as required by law.
34. ENTRY
a. To participate in the Promotion, you may enter via the following method(s):
i. VIA INTERNET – Entries will be accepted on the Group's websites at www.greensburgdailynews.com/diamonddrop, www.rushvillerepublican.com/diamonddrop,www.greensburgdailynews.com/diamonddrop, www.rushvillerepublican.com/diamonddrop, and www.batesvilleheraldtribune.com/diamonddrop.www.batesvilleheraldtribune.com/diamonddrop. Follow the links and instructions to enter and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address and the time you Marble Guess (as defined below) in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address..
ii. IN PERSON ENTRY – Entries will be accepted during regular business hours at Huntington Jewelry located at 122 East Washington Street, Greensburg, IN., 47240. . Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Group. The contest/sweepstakesAt the store, participants will be asked to fill-out an entry form with the following information: first name and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address and the participant's Marble Guess (as defined below).
b. You may enter as many times as you wish, provided that you do not use an automated means of entry.
c. All completed entries must be received no later than the time specified in Section 2 on the last day of the Promotion Period to be eligible to win the prize ("Eligible Entries"). Submissions received after this date and time will not be valid. Personal information collected from entries is subject to the Privacy Policies as set forth at http://www.greensburgdailynews.com/site/privacy.html, http://www.rushvillerepublican.com/site/privacy.html and http://www.batesvilleheraldtribune.com/site/privacy.html which are incorporated herein by reference. Proof of submission does not constitute proof of delivery. By submitting an entry, participants agree to abide by these Official Rules. Automated entries or entries generated by robots or scripts are prohibited and will result in immediate disqualification of any and all associated entrants. Persons submitting entries under false pretenses will be disqualified. If for any reason the Internet portion of the sweepstakes is not capable of running as planned, including infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the sweepstakes, Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify, or suspend the Promotion. Sponsors reserve the right, in their sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify, or suspend the Promotion. Sponsors have no obligation to notify a participant of his/her disqualification. CAUTION: any attempt by a participant to undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and, should such an attempt be made, Sponsors reserve the right to prosecute and seek damages from any such participant to the fullest extent of the law. Sponsors are not responsible for any lost, late, incomplete, illegible, inaccurate or misdirected entries. Entries will not be returned and will become the property of the Sponsors for promotional and other use, and by entering participants assign any and all rights in and to the entries, and copyrights thereof, to the Sponsors. By entering, each participant authorizes the Sponsors to use his or her name, likeness and image in its advertising and promotional materials. The promotion administrator's computer is the official time keeping device for the Promotion. For purpose of this Promotion, a "Day" shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET.
IN PERSON ENTRY – Entries will be accepted during regular business hours at Huntington Jewelry, 122 East Washington Street, Greensburg, IN., 47240. At the store, contestants will be asked to fill-out an entry form with the following information: first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address.
b. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion's administration, prizes or promotion. You are providing entry information to SEI Media Group and not to Facebook.
c. You may enter as many times as you wish, provided that you do not use an automated means of entry
4. PRIZES
a. The winner will receive one (1), one (1) carat loose diamond. The prize will be awarded "as is" with no warranty or guarantee, either express or implied by Group. Approximate Retail Value ("ARV") of Prize $1,200.00.
b. Odds of winning are dependent upon the number of qualified entries received and upon entrants' ability to correctly guess the time at which a marble will drop out of an ice sculpture on display at Huntington Jewelry, 122 East Washington Street, Greensburg, IN., 47240.
c. There is no substitution, transfer, or cash equivalent for prizes, except that the Group may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
5. WINNER SELECTION AND NOTIFICATION
a. Decisions of Group management with respect to the Promotion are final.
b. An ice sculpture with a marble inside it will be on display at Huntington Jewelry, located at 122 East Washington Street, Greensburg, IN.,, 47240. ContestantsParticipants will be asked to guess the date and, hour, minute, and second (using the format 00:00:00) at which time the marble will drop out of the ice sculpture. ("Marble Guess"). The contestantparticipant, who guesses the closest to the time, by identifying either AM or PM, will be the winner. In the event of a tie, the winner will be chosen from among the tied entries via a random drawing conducted by the Group. If the marble does not drop out of the sculpture byon or before 5:00 pm ET on Friday, February 12th 12, 2016, a winner will be selected via random drawing conducted by the Group from among all entriesEligible Entries received on Friday, February 12, 2016 at approximately 6:00 pm ET.
cb. Winner need not be present to win.
dc. Winner will be notified via phone and/or email on or before February 15th 15, 2016. The exact notification date will depend upon the date and time at which the marble drops from the ice sculpture. Winner must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by the Group by selecting the entry that guessed the next-closest time of the drop or by conducting a random drawing from among all entries received if the marble does not drop by the entry deadline. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner will be disqualified and will forfeit the prize.
e. The winnerd. Winner must pick up the prize in person from Huntington Jewelry, located at 122 East Washington Street, Greensburg, IN.,, 47240.
fe. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. Prize or prize certificates will not be mailed to the winner without the winner's prior written consent in which the winner shall agree to assume its risk of loss. The Group, its sponsor(s), or promotional partner(s) are not responsible for the safe arrival of a prize or prize certificate.
f. Winner's name will be posted at www.greensburgdailynews.com; www.rushvillerepublican.com; and www.batesvilleheraldtribune.com and available for viewing during regular business hours at the main office of the Greensburg Daily News, 135 S. Franklin Street, Greensburg, IN, 47240. The identity of the winner may be also be requested by printing your name, address, phone number and the words "Request for winners' names – The Diamond Drop Contest" on a 3" x 5" card, inserting the card into an envelope and mailing it with sufficient postage to: Greensburg Daily News, 135 S. Franklin Street, Greensburg, IN, 47240. All such requests must be received within thirty (30) days following completion of the Promotion.
6. PRIZE
a. Winner will receive one (1), one (1) carat loose diamond. The prize will be awarded "as is" with no warranty or guarantee, either express or implied by the Sponsors. Approximate Retail Value ("ARV") of the Prize is $1,200.00. The provided approximate retail value of the prize is an approximation. Any difference between the approximate retail value and the actual cost of any prize will not be awarded.
b. Odds of winning are dependent upon the number of Eligible Entries received and upon entrants' ability to correctly guess the time at which a marble will drop out of an ice sculpture on display at Huntington Jewelry.
c. Actual prizes may differ from those shown in advertisements. Sponsors reserve the right to change any actual prize at any time during the Promotion. In this event, every effort will be made to provide a prize of like estimated value. Sponsors do not warrant or make any representations in connection with the prize, express or implied. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. All costs and expenses not specified in the above prize descriptions, if any, are the sole responsibility of the prize winner. Unclaimed prizes will not be awarded. No more than the advertised number of prizes will be awarded.
7. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winnerswinner. Winner will be required to complete and submit an IRS Form W-9 or the equivalent including the winner's full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the GroupSponsors in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of prize constitutes winner's and guest's (where applicable) permission for the Group or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize Everything for the Promotion is provided as is, without warranty of any kind, express or implied. By entering, participants consent to the exclusive venue and jurisdiction of the state and federal courts of Greensburg, Indiana, in all disputes arising out of or related to these rules or this sweepstakes. The Promotion is governed and construed under the laws of the State of Indiana, excluding its conflict of laws principles.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Group in its sole discretion may require verification of Promotion winner's or winners' identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, winner(s) and guests (if applicable) agree to release and hold harmless the Group, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the "Released Parties") against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Group may also require eligible Promotion winner(s) and their guests or travel companions, if any, to sign a liability release confirming such consent. It is the responsibility of the winner(s) to ensure that their guest(s) or travel companion(s) sign and return to the Group any required release.
d. The Group, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Group's web channel or is otherwise in violation of the rules. The Group further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Group's control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Group in its sole discretion. Any attempt by an entrant or any person to deliberately damage any Group web channel(s) or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Group reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Group's failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Group, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Group reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Group's control.
f.
